By accepting delivery of the products and services described in Oriental Gemco invoice or other documentation, customer agrees to be bound by and accepts these terms and conditions of sale unless customer and Oriental Gemco have signed a separate agreement, in which case the separate agreement will control.

These terms and conditions of sale constitute a binding contract between you ("Customer") and Oriental Gemco. Customer accepts these terms and conditions of sale by making a purchase or placing an order on the www.orientalgemco.com . These terms and conditions of sale are subject to change without prior notice, except that the terms and conditions of sale posted on the Site at the time Customer initially places or modifies an order will govern the order in question.

These terms and conditions of sale constitute the entire agreement between Customer and Oriental Gemco relating to the terms and conditions of sale of products and services on the Site.

Customer consents to receiving electronic record, which may be provided via a Web browser or e-mail application connected to the Internet.

Customer may issue a purchase order for administrative purposes only. Additional or different terms and conditions contained in any such purchase order will be null and void. Customer agrees that the terms and conditions of sale contained herein and in Oriental Gemco invoice or other documentation will control all the transactions. No course of prior dealings between the parties and no usage of trade will be relevant to determine the meaning of these terms and conditions of sale or any purchase order or invoice related thereto.

Unless otherwise stated, all stones are heated, treated, or enhanced. Some of the enhancement methods used are heating, oiling, filling with resin agents, etc. Some of the treatment methods are coating, diffusion, dyeing, joban oil, glass filling, irradiation, laser treatment, etc. Prevailing market values are based on these universally practiced and accepted processes, by gem and jewelry trade. Title and Risk of Loss

The title to products and risk of loss or damage will pass to the customer upon delivery by Oriental Gemco to the shipping carrier period; Oriental Gemco will obtain third-party insurance at its own expense and assist the Customer in filing any claims with the insurance company arising from loss or damage to the shipment during transit. Oriental Gemco retains a security interest in the products until payment in full is received. Customer will be responsible for all shipping and related charges.

Limitation of Liability

Neither Oriental Gemco nor its affiiates will be liable for lost profits, loss of business or any consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third parties. Neither oriental gemco nor its affiliates will be liable for products not being available for use or lost or damaged.

Oriental Gemco will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency. Anticipated delivery dates are based upon our production department schedules and information supplied by other manufacturers. Such information may change. The shipping dates provided by Oriental Gemco are estimates only.

Pricing

All prices are subject to change. Oriental Gemco reserves the right to make adjustments to prices, products and service offerings for reasons including, but not limited to changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements. All orders are subject to product availability. Therefore, Oriental Gemco cannot guarantee that it will be able to fulfill all the Customer's orders.

Governing Law

These terms and conditions of sale and any sale hereunder will be governed by the laws of the state of New york, U.S.A., without regard to conflicts of laws and rules. Customer consents and submits to the jurisdiction of the federal and state courts located in new york and therefore waives the right to change venue.

All forms of payments are accepted including major credit cards, checks, cashier checks, wire transfer, our website only accepts credit card payments for shipments within united states. Return Policy

Customer satisfaction is very important to us. Please be sure to contact our Sales Advisor for specific conditions for the return of a particular product before you make a purchase. Generally products can be returned for replacement or store credit according to following terms and conditions.

All sales are final. No returns, exchange only. Items on closeout, special sale, metal wire and chains, strands from the bunches (indicated on the site with letter NR (NO RETURNS) are final sale.
No returns will be accepted without a Return Authorization (RA) Number.
Return Authorization Number may be requested with in __7__ days from the receipt of the merchandise.
All products must be received by our Returns Processing Center within 10 (usually most carriers deliver in this time frame) days of your receipt of a Return Authorization Number. Items received after 10 days will be refused. All RA numbers must appear on the shipping labels we provide on the back of your packing slip. All items must be returned unaltered with original packaging, including all tags and labels.
PLEASE NOTE: When returning product we strongly recommend to use a traceable shipping method.
Replacement products orders will not be shipped until the original item is received and inspected. Once the item has been conformed defective, the replacement will be shipped. If the defective item is being returned for credit, the credit will not be issued until the item has been inspected and confirmed defective. We can however; ship new product with a secure payment and issue a store credit once the returned product has been processed.
On all others there will be a 40% restocking fee.
Shipping and handling charges are not refundable. The customer is responsible for shipping charges and insurance on all return shipments.
Any deviation from the return policy outlined above will result in a delay of your refund, additional restocking fees, or refusal of your return.
All items in stock are usually shipped the same day on orders received before 1 pm EST.
You may cancel any www.orientalgemco.com order as long as it has not been processed/shipped.
